Why Has My Insurance Claim Been Denied?


Under Louisiana law, your insurance company has a duty to pay your claim if you have submitted satisfactory proof of your loss.


What the statutes require and how your insurance company behaves, however, are two entirely different things. Your insurance company may deny your claim by alleging that your damage is not covered by your policy, that your premiums were not paid in a timely manner, or that you misunderstood your policy.


Often, your claim may be denied simply because it is in the best financial interest of your insurance company. After all, the company cannot be profitable if they pay every claim. Many insurance companies deny claims because they bet that most policy holders will not hire legal counsel to dispute their claim denial.
