Loss of Children: A Louisiana Couple’s Nightmare

In June 2014 a Louisiana couple lost two of their young children in a tragic accident. Late last year,a jury awarded the couple $4.4 million dollars in damages after finding 2 parties negligent.

Family Time Turns Tragic

31-year-old David Lanus often enjoyed fishing with two of his children, nine-year-old Sarai and and six-year-old Danus. On the day of the accident they went fishing with two other adults off the side of State Road 928 (Bluff Road) in Ascension Parish.

At some point 47-year-old Shawnette Taylor ran her 2004 Nissan Armada off the road and down the embankment, striking all five members of the fishing party. Shawnette Taylor told investigators she had been trying to avoid an oncoming car that was driving erratically.

Tragically, Sarai and Danus were pronounced dead at the scene. The children’s father broke his leg and one of the other adults, Mitchell Jonon Jr., also received injuries and ultimately received a judgment of just over $1 million.

Who Was Responsible for the Death of the Lanus Children?

The wrongful death suit alleged that the “dangerous and negligent design and maintenance” of the S-shaped portion of Bluff Road was a significant cause of the accident. While the Department of Transportation and Development claimed that the Lanus family bore at least part of the blame, the jury disagreed and found the agency 60 percent at fault.

Taylor received the other forty percent of fault. In October 2014 a grand jury declined to indict Taylor on two charges of negligent homicide, but she was cited for careless operation of a motor vehicle, a misdemeanor.

The $4.4 million award given to Lanus and Shayla included compensation for his medical bills and also, loss of wages.
